Early Listing Agreement Disclaimer Seller and Broker agree that the Contract becomes effective and exclusive as of the date of Seller’s execution of this contract, (“Effective Date”). Seller and Broker understand and agree that the Effective Date of this Contract is not necessarily the same date the Property is actively offered for public sale, but that each party are bound by the terms and obligations stated herein as of the Effective Date. ​ EMD Disclaimer Notwithstanding anything to the contrary in Section 21, Buyer and Seller are not required to submit to mediation when the only matter at issue is the disposition of the EMD. Either party may seek other remedies available. Electronic Communications Disclaimer (For Email Signature) Emails sent or received shall neither constitute acceptance of conducting transactions via electronic means nor shall create a binding contract in the absence of the fully signed written contract.
